Welcome to the site or application www.dickiesindonesia.id (“Site/Application”) owned by PT Surya Bumi Retailindo (hereinafter referred to as “SBR”, “Seller”, or “We”). You must read, understand, accept and agree to all the terms and conditions on this Site/Application before using, accessing and/or receiving the content contained therein (hereinafter referred to as the "Applicable Terms and Conditions"). Applicable Terms and Conditions is an agreement between Users and SBR which contains a set of rules that regulate the rights, obligations, responsibilities and procedures for Users and SBR in using SBR services.
If you are under 18 (eighteen) years of age, you must obtain consent from your parent or guardian before (i) accessing or using this Site/Application; (ii) agree to the Applicable Terms and Conditions; and/or (iii) make purchases of goods and/or services offered on this Site/Application.
By accessing or using the Site/Application (including, but not limited to, purchasing goods and/or services offered), you are deemed to have (i) understood and agreed to all contents of the Terms and Conditions contained in this Site/Application; and/or (ii) if you are under 18 (eighteen) years of age, obtain the consent of your parent or guardian.
1. Definition
1.1. Other Fees are credit card service fees, transfer fees, service fees, and/or other fees that are not the Purchase Price charged by SBR, Payment Service Providers, and/or Non-Payment Service Providers.
1.2. Delivery Fees are the shipping costs for a Product charged by the Non-Paying Service Provider, and are not included in the Purchase Price.
1.3. The Purchase Price is the price stated on the Product on this Site/Application, and does not include Delivery Fees and Other Fees.
1.4. Content is all material or information contained in or available through this Site/Application, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data combinations, software, and all intellectual property rights in This Site/Application.
1.5. Purchases are shopping transactions or product purchases made by Users through this Site/Application.
1.6. Users or you are the party who uses the services of this Site/Application, including but not limited to purchasing, or accessing information or content contained in this Site/Application.
1.7. Non-Payment Service Provider is any party that collaborates with SBR in providing non-payment services for each Order, including but not limited to expedition/logistics companies.
1.8. Payment Service Provider is any party that collaborates with SBR in providing banking services or payment services.
1.9. Orders are the result of Product Purchases by Users through this Site/Application which must be fulfilled by SBR. Each Order will have one unique Order number but may consist of several invoice numbers.
1.10. Products are goods or services offered by Sellers on this Site/Application that can be purchased by Users.
1.11. The Resolution Center is a service provided by SBR and which can be used by Users to obtain any information regarding SBR services, Purchase procedures, Order status, guarantees, Product returns, refunds, and other matters related to this Site/Application. 1.12. The shop is a party that collaborates with SBR in connection with every product offered or sold by SBR on this Site/Application.
2. Account
2.1 In order for you to make Purchases on this Site/Application, you must first register your account in accordance with the procedures specified in this Site/Application. These procedures may be changed by SBR from time to time.
2.2 When registering an account, the User represents and guarantees to SBR that:
- a. Users are individuals who have reached the age of 18 (eighteen) years or more when using SBR services;
- b. In the event that the User is under 18 years of age, the User has obtained consent from the parent/guardian;
- c. Users are individuals/legal entities/business entities with legality as required by applicable laws and regulations in the jurisdiction of the Republic of Indonesia;
- d. Users are not individuals and/or legal entities who are prohibited by the laws of the Republic of Indonesia from receiving or using SBR services; And
- e. Users declare that all information and/or documents filled in or submitted to SBR are accurate, correct, complete, current and appropriate.
2.3 Users are fully responsible for the confidentiality of User account information, including email addresses, passwords, voucher codes, membership and other things.
2.4 SBR has the right to carry out checks regarding the truth, validity of information or documents submitted to SBR. For any reason (including if there are indications of fraud or non-compliance based solely on SBR's judgment), SBR has the right to terminate, cancel or block User access and accounts to this Site/Application service.
2.5 Users can change account information such as name, address, telephone number and email address in accordance with the procedures specified in this Site/Application and/or other methods determined by SBR. Users are only permitted to use one email address to register on this Site/Application.
2.6 SBR does not charge fees for registration or changes to account information from Users.
2.7 SBR has the right to verify the User's telephone number and email address using a one-time password (OTP) or other method determined by SBR from time to time.
2.8 Users are prohibited from selling, attempting to sell, offering to sell, giving, handing over or transferring accounts to third parties without the prior written consent of SBR. In the event that a User violates these provisions, all consequences, risks and/or losses that arise are the sole responsibility of the User.
3. Use of Services
3.1 Users agree to comply with any policies, procedures, guidelines, instructions and notices relating to SBR services.
3.2 Access to this service is only permitted for Purchasing purposes and interests as well as information related to SBR services.
3.3 Users are prohibited from loading or publishing Content that violates third party intellectual property rights.
3.4 Users are prohibited from using or uploading software or materials that contain/are suspected to contain viruses, destructive components, malicious code, or other harmful components that can or have the potential to damage data, cause damage, or interfere with the operation of this Site/Application.
3.5 Users are not permitted to reproduce, distribute, display, sell, rent, transmit, create derivative works from, translate, modify, reverse engineer, disassemble, decompile or exploit any Content contained in this Site/Application.
3.6 SBR has the right to monitor, filter or control any activity, content or material contained in this Site/Application.
3.7 SBR has the right to take action that is deemed appropriate and appropriate if there is misuse of the service or violation of the Applicable Terms and Conditions by the User.
4. Product Description and Accuracy
4.1 A description of the main characteristics of the Product can be found on the Product page on this Site/Application. SBR strives to provide as accurate Product descriptions as possible. However, SBR cannot guarantee that all descriptions or content of a product contained in this Site/Application are accurate, complete and/or current.
4.2 User understands and agrees that:
- a. All Product specifications are obtained by SBR from the manufacturer, but these specifications can be changed at any time by the manufacturer without prior warning or notification to SBR;
- b. The color accuracy of the monitor screen may vary depending on the lighting, settings, or resolution of the User's monitor screen. Thus, the color of the Product received may be different from the color that the User sees on the User's monitor screen; And
- c. Product availability listed on this Site/Application may not correspond to actual availability, which can be caused by damaged/defective Products, system errors, and/or other technical errors. Therefore, the User understands and agrees that SBR has the right to transfer, refuse or cancel the relevant Order.
4.3 For each Order received, SBR will carry out an inspection to ensure the conformity of the Product with the information contained on this Site/Application. If, based on SBR's opinion, there are inaccuracies/non-conformities, then SBR has the right to refuse/cancel the Order.
4.4 A Product sold on this Site/Application may be a Product that is not always available and therefore requires prior ordering (Pre-Order). This Site/Application or SBR will inform the User if a Product ordered by the User is a pre-order Product.
5. Transaction and Purchase Price
5.1 The Product price stated on the Product page includes all applicable taxes. Product prices may vary and may only be available for a limited period. All prices and offers are subject to availability and may be withdrawn or changed at SBR's discretion. Prices on this Site/Application may be different from prices in stores, catalogs or elsewhere.
5.2 This Site/App contains a large number of Products and it is possible that, despite Our best efforts, some of the Products listed on this Site/App may be incorrectly priced. If SBR finds an error in the price of the Product you ordered, SBR will inform you of this as soon as possible. In addition to SBR's right to cancel any Order, SBR will give you the option to reconfirm your Order at the correct price or cancel it.
5.3 A Purchase will be deemed to have been accepted (and subsequently become an Order) and processed by SBR after payment of the Purchase Price, Delivery Fees and Other Fees (if any) is received in full by SBR.
5.4 Products that have been purchased cannot be returned or exchanged for other products unless otherwise regulated in the Applicable Terms and Conditions.
5.5 The User understands and agrees that apart from the Purchase Price, the User must bear the Delivery Costs and Other Costs arising from a Purchase. SBR is not responsible for any imposition of such fees by third parties in connection with a Purchase.
5.6 The User agrees that SBR has the right to refuse or cancel, either part or all of the Order, in the event that there is a Product price error, promotional error or other error displayed on this Site/Application even though the User has made payment for the Order.
6. Payment
6.1 SBR collaborates with Payment Service Providers in providing various payment methods on this Site/Application that can be used by Users in accordance with the Applicable Terms and Conditions. The following are the payment methods that Users can choose:
- Transfer.
- Credit Card - Payment by credit card is valid for credit cards with the VISA, MasterCard, American Express, or JCB logo in collaboration with SBR.
- Online Debit (valid for debit cards with the VISA or MasterCard logo in collaboration with SBR).
- E-Wallet (Go-Pay and others).
The payment methods that can be used by the User mentioned above will be displayed on this Site/Application when the User wants to make payment for a Purchase.
6.2 When making purchases on this Site/Application, Users are required to use the payment method above. Users are also required to comply with and be bound by all terms and conditions that apply to each Payment Service Provider.
6.3 Users are obliged to pay the full Purchase Price, Delivery Fees and Other Fees within the time period specified for each payment method selected by the User. SBR has the right to cancel the Order if payment of the Purchase Price, Delivery Fees and Other Fees has not been made by the User within the specified time period.
6.4 The User understands and agrees that if there is a price discount, promotion or other benefit on the Order that has been made but the User does not make payment by the specified time limit, the Order will be canceled (including the price discount, promotion or other benefit). In such case, such price discount, promotion or other benefit may become unavailable for any subsequent Orders.
6.5 SBR may charge the User an administration or service fee for each payment method chosen by the User. These administration or service fees will be displayed and informed to the User before the User makes payment of the Purchase Price. Administrative or service fees charged by SBR (if any) will be included in the Other Fees component.
6.6 Payment Service Providers may charge Users an administration or service fee for each payment method chosen by the User. Administration or service fees charged by Payment Service Providers may not be displayed and communicated to Users on this Site/Application before Users make payment. Administration or service fees charged by the Payment Service Provider (if any) will be included in the Other Fees component.
6.7 For each payment method chosen by the User, the User understands and agrees to the following:
- a. The User must make payment for the Order in the amount displayed on this Site/Application according to the User's choice of payment method.
- b. Errors made by the User (including transfer errors, errors in entering required information, etc.) are the sole responsibility of the User.
- c. As long as it is available and by following the applicable provisions in SBR, Users can take advantage of the installment program provided by the credit card issuing bank.
- d. Users are prohibited from using credit card or E-Wallet payment methods other than those intended as a means of payment. If there is a Product Purchase transaction using a credit card or E-Wallet that violates legal provisions and/or Applicable Terms and Conditions, then SBR has the authority to withhold transaction funds for as long as required by SBR and/or the Payment Service Provider to carry out the necessary investigations.
- e. SBR has the authority to carry out investigations into credit card or E-Wallet transactions by holding the payment verification process before the transaction is processed until a certain time limit until receiving confirmation from the relevant Payment Service Provider if there are indications of violations of applicable legal provisions and/or Applicable Terms and Conditions .
- f. In the verification process carried out by the relevant Payment Service Provider, the User may be contacted by the relevant Payment Service Provider. If the User does not deny or cancel the verification, then SBR will process the Purchase and Order transaction, and SBR is not responsible if any loss occurs due to the User's negligence.
- g. The User understands and agrees that the User is personally responsible for maintaining the confidentiality and/or security of the User's data by maintaining the confidentiality of data and information, including but not limited to, Debit Card numbers, Credit Cards, Credit Card CVV codes, and verification SMS codes or OTP (One-time Password) SMS code that has been sent by the relevant Payment Service Provider when the User makes a Purchase transaction.
- h. If the Purchase transaction is unsuccessful and/or cancelled, then the bill for the transaction will be canceled and the transaction funds (if any) will be returned to (i) the User's bank account; (ii) User's credit card limit on the next bill; and/or (iii) the User's E-Wallet (whichever is in accordance with the applicable provisions of the Payment Service Provider).
6.8 For each payment that has been received in connection with an Order, SBR will send notification of receipt of payment to the User via the User's email address registered with SBR.
6.9 The User understands and agrees that all losses arising as a result of providing payment services (including in the event that SBR does not receive payment that has been successfully made by the User as a result of an error by the Payment Service Provider) are fully the responsibility of the User and the Payment Service Provider.
7. Delivery
7.1 Customers must include a valid telephone number in the profile, as well as enter a shipping address each time the Customer makes a Purchase. SBR is not responsible for User errors or mistakes in writing addresses and telephone numbers for Product delivery purposes.
7.2 SBR provides several Product delivery options, as follows:
7.2.1 Self Pick-Up in Store
- As long as (i) you have paid the Purchase Price and Other Fees; and (ii) SBR determines that the Product can be picked up by Self Pick-Up at the Store, you can pick up the Product at the Store that you have selected in the Order.
- SBR will inform you of the time to pick up the Product at the Store, and you must pick up the Product at the Store during the Store's operational hours no later than 2 (two) calendar days after SBR confirms and processes your Order. SBR has the right to charge additional fees for any delays you make in picking up the Product at the Store.
- Users can take orders or be represented by other people during shop operating hours by mentioning or showing proof of the order and payment. SBR has the right to verify the User or his representative to ensure that the User or his representative is the party entitled to collect the Product.
- Users or their representatives are required to check the Product when picking up the Product. After collection of the Product, SBR is not responsible for any incompatibility, malfunction, or damage to the Product unless this is covered by the warranty for a Product.
7.2.2 Delivery by Non-Paying Service Providers
- The choice of Non-Payment Service Providers who collaborate with SBR along with Delivery Fees can be seen when the User makes a Purchase on this Site/Application.
- Shipping costs depend on the weight of a Product, the delivery address, and shipping rates determined by the Non-Payment Service Provider.
- Within 3 (three) working days after SBR receives the Purchase Price, Delivery Fees and Other Fees (if any), SBR will send the Products to the User via the Non-Payment Service Provider selected by the User, as stated in the Order.
- Users understand and agree that the Non-Payment Service Provider is not an agent of SBR and is an independent party that provides product delivery services. Thus, SBR is not responsible for delivery errors, damage to Products that occur during delivery, and/or other losses incurred by Non-Paying Service Providers.
7.3 Any provisions regarding the Product delivery process are the sole authority of the Non-Payment Service Provider. Users are also obliged to comply with and be bound by all terms and conditions that apply to each Non-Payment Service Provider.
8. Guarantee
8.1 SBR guarantees that all products offered on this Site/Application are genuine or original products. However, not all Product manufacturers provide a guarantee for the Product. Users must read the Product description for information regarding (i) the availability of the Product warranty; (ii) coverage and exclusions of warranties; and (iii) other matters related to the guarantee.
8.2 Users understand and agree that the terms, conditions and validity period of the warranty refer to the applicable warranty provisions of the Product manufacturer.
8.3 When the User services the Product, there are some spare parts that are not covered by the warranty so that service costs will result. Service must be carried out in a place that corresponds to the service location in the warranty provisions.
8.4 Submission of a warranty claim for a Product is carried out in the following manner:
- a. The User must contact the Resolution Center (or through the Store where the User picks up the Product) and inform about the problem that has occurred;
- b. The User must bring or send the problematic Product (at the User's expense) to a place informed in writing by SBR by attaching supporting documents required by SBR (including but not limited to, User's identity card, proof of Product Purchase and payment, warranty card , and other relevant information); And
- c. Warranty claims will be forwarded by SBR to the manufacturer of each Product.
8.5 The User understands and agrees that the warranty claim process may require inspections, investigations and other technical measures, which will require time that cannot be estimated in advance. Furthermore, all final decisions regarding warranty claims are the authority of SBR and/or the manufacturer of each Product.
9. Limited Liability
9.1 If SBR fails to comply with the Applicable Terms and Conditions, SBR will only be liable to you for the Purchase Price of the Products.
9.2 Nothing said or stated by a salesperson on behalf of SBR should be understood as a variation of the Applicable Terms and Conditions or as a representation by SBR about the nature or quality of any Product.
9.3 Any suggestions given by SBR sales personnel during the ordering process are based entirely on the information the User provides. If suggestions are given after visual inspection by SBR sales personnel, such suggestions constitute SBR's opinion only and SBR is not responsible for any inaccuracies therein.
9.4 The User confirms that the User must comply with any and all rules relating to the installation and use of the Product and fully accepts that SBR is not responsible for any loss resulting from forced, misdirected, inappropriate or unqualified installation or use of the Product , or Products that have not been properly maintained. In addition, SBR is not responsible for death or personal injury, unless caused directly by SBR's own negligence and proven according to law.
9.5 Any Product, or part thereof, modified or adapted by the User or any third party is no longer warranted by the manufacturer and SBR shall not be liable for any failure resulting from such modification or adaptation.
9.6 To the extent permitted under applicable statutory provisions, SBR shall not be liable for any losses resulting from its failure to comply with the Applicable Terms and Conditions which fall into the following categories: (a) loss of income or income; (b) business losses; (c) loss of profits; (d) loss of anticipated savings; (e) data loss; or (f) waste of management or office time; and/or (g) other indirect losses, consequential losses, damages or expenses. However, nothing in the Applicable Terms and Conditions is intended to exclude or limit SBR's liability for matters for which it would be illegal for SBR to exclude or attempt to exclude its liability.
10. Member Points and Promotions
10.1 Member Points
- You have the right to get member points for every product purchase you make on this Site/Application.
- Subject to changes that may be made by SBR from time to time, for every Product Purchase in multiples of IDR 100,000 (one hundred thousand Rupiah), you will get 1 member point. Member points cannot be cashed and/or transferred to any third party. Member points that are not used within a certain period of time (determined by SBR) will expire and cannot be used.
- You can check the member points collected on this Site/Application. Member points can be used as a discount on the Purchase Price for the next purchase of certain Products subject to the terms and conditions determined by SBR from time to time.
10.2 Promotion
- SBR has the right to carry out promotional activities with special terms and conditions that vary from one promotion to another. Users are expected to read carefully each terms and conditions that apply to ongoing promotions.
- In the event of promotional errors, including but not limited to images, specifications, prices, colors, packaging, quantities, promotional quotas, SBR has the right to cancel the relevant Order.
- If it is suspected/found that there are indications of promotional violations committed by Users that are detrimental to SBR, then SBR has the right to take legal action in accordance with the provisions of applicable laws and regulations.
11. Order Cancellation and Return of Purchase Price (Refund)
11.1 Users understand and agree that SBR has the right to cancel Orders in accordance with the provisions stated in the Applicable Terms and Conditions. Upon cancellation of an Order made by SBR, SBR will refund the Purchase Price and Delivery Fees (as long as these costs have not been incurred by SBR) which have been paid in full by the User.
11.2 Users can request cancellation of an Order as long as the Order has not been prepared by SBR and/or the Store. SBR has the right to (i) refuse a request to cancel an Order if the Order is already in the Order preparation process by SBR and/or the Shop; and/or (ii) charge an Order cancellation fee, the amount of which will be determined by SBR (“Order Cancellation Fee”). Upon cancellation of an Order made by the User and approved by SBR, SBR will refund to the User the Purchase Price and Delivery Costs (as long as these costs have not been incurred by SBR) minus the Order Cancellation Fee (if any).
11.3 For canceled orders, SBR and/or the Payment Service Provider will issue a refund to the User according to the initial payment method chosen by the User in accordance with the applicable provisions of SBR and/or the Payment Service Provider. The refund process will take in the range of 7 (seven) to 30 (thirty) working days from the date the Order cancellation is approved by SBR.
12. Product Returns (Returns)
12.1 It is generally understood and agreed by the User that any Product that has been purchased cannot be exchanged or returned without written approval from SBR. However, the User has the right to return the Product as long as one or more of the following conditions are met:
- a. Damaged product, and/or
- b. Defective products, and/or
- c. Subject to other terms and conditions in the Applicable Terms and Conditions, the Product does not match the description on this Site/Application, and/or
- d. Incomplete product, and/or
- e. The product does not match the order.
12.2 SBR has the right to refuse to return the Product if the Product experiences problems or damage caused by the User's error, negligence, carelessness, carelessness and/or careless use, including but not limited to the following:
- a. Usage error; and/or
- b. Product size and/or color errors; and/or
- c. Dropped, hit, or scratched; and/or
- d. Exposed to liquid; and/or
- e. Accident; and/or
- f. Natural disasters; and/or
- g. Installation error; and/or
- h. It has been disassembled; and/or
- i. Altering or damaging warranty stickers, serial numbers, and signs of authenticity; and/or
- j. Modify or repair.
12.3 Apart from fulfilling the provisions above, product returns can only be made in accordance with the following provisions:
- a. The User must submit a Product return application to SBR by contacting the Resolution Center (or through the Store where the User took the Product) within 7 (seven) calendar days after the User receives or takes the Product;
- b. Users must complete the following:
- Product Photos (minimum 3 (three) photos from different sides).
- Unboxing video when you receive the Product and video regarding problems with the Product.
- Information and chronology of related events.
- Reason for returning the Product.
- Invoice and proof of payment for Products.
- c. Returned products must be packaged in their original cardboard or standard packaging.
- d. Users must return the Product to the address specified and informed in writing by SBR.
- e. For returned products, SBR will check the products. In the event that in SBR's reasonable opinion, the Product has already been used or meets the provisions of Article 12.2 above, SBR has the right to refuse to return the Product.
12.4 For any reason, a Product sold with a certain discount or certain promotion cannot be exchanged or returned.
12.5 Users are responsible for any costs incurred in connection with returning Products, including but not limited to, Delivery Fees, transfer fees and other related costs.
12.6 If the application for returning a Product is approved by SBR, in accordance with the agreement between SBR and the User, SBR will (i) exchange the Product (with Delivery Costs being the User's responsibility); or (ii) a refund of the Purchase Price, each of which will be made in accordance with the Applicable Terms and Conditions.
13. Violation
13.1 If indications of violations of the Applicable Terms and Conditions and/or abuse by the User are suspected or found, including but not limited to:
- a. Creation of more than 1 (one) account by the same 1 (one) User; and/or
- b. Use of the same telephone number; and/or
- c. Use of the same delivery address; and/or
- d. Misuse of account/credit/debit/identity card numbers; and/or
- e. Manipulate or manipulate purchases, promotions and/or member points.
SBR has the right to take necessary actions, including but not limited to:
- i. Canceling User Orders;
- ii. Attract promotions, discounts, member points, or other benefits;
- iii. Request a return of subsidies, promotions, discounts, member points, or other benefits that Users have received;
- iv. Close and deactivate User accounts;
- v. Report Users to the Republic of Indonesia Police Office if there are indications of criminal conduct; and/or
- vi. Carry out other legal actions in accordance with applicable laws and regulations.
14. Electronic Communications
Every communication and correspondence between Users and SBR regarding Products, Purchases, Orders, and other matters, as well as other information (including without limitation regarding additional conditions for Purchases or Orders, changes, notifications, reports, data updates, and/or promotions carried out by SBR) will be carried out through digital/electronic communication media (including without limitation via email, telephone and other digital/electronic communication media that will be used by SBR), from time to time in accordance with applicable procedures.
15. Privacy Policy
15.1 Users can see the SBR Privacy Policy which contains how to collect, use or disclose Users' personal information, and User protection practices on this Site/Application.
15.2 By agreeing to the Applicable Terms and Conditions, Users also agree to all the contents of the SBR Privacy Policy as stated on this Site/Application.
16. Intellectual Property Rights
16.1 SBR is the legal holder of this Site/Application and all Content on this Site/Application.
16.2 No part of this Site/Application may be reproduced, engineered, separated, modified, distributed, republished, displayed, broadcast, hyperlinked, framed, transferred or transmitted in any way or stored/installed in an information retrieval system or installed on a server, system or equipment, without prior written permission from SBR or from the owner of the relevant intellectual property rights.
17. System Development
From time to time, SBR will develop the system over time to provide more convenience to the User's shopping experience. During this process, SBR has the right to cancel the User's Order if any discrepancy is found which could harm the User or SBR.
18. Indemnification
Users hereby release SBR from claims for compensation and defend/release SBR (including shareholders, Directors, Commissioners and Employees) from any claims or demands, including reasonable legal costs, made by third parties that arise if Users violate the Terms and Conditions. Applicable Provisions, improper use of SBR services, and/or User violations of law or third party rights.
19. Separability
If a part or provision of the Applicable Terms and Conditions becomes invalid or unenforceable due to applicable laws and regulations, the User agrees that such invalidity does not affect other parts of the Applicable Terms and Conditions. SBR will endeavor to amend these provisions to comply with applicable laws and regulations.
20. Disputes and Choice of Law
Applicable Terms and Conditions are governed and interpreted based on the laws of the Republic of Indonesia. All disputes that may arise between Users and SBR in connection with the Applicable Terms and Conditions and/or use of this Site/Application will be resolved through the West Jakarta District Court.
21. Discrepancies in Information and Links to Other Sites

22. Force Majeure
22.1 Neither Party shall be responsible for any delay or failure in any obligation (except the obligation to pay) under these Applicable Terms and Conditions which is caused by a Force Majeure Event, provided that the party who is delayed or hampered by the Force Majeure Event has made maximum efforts perhaps to avoid this.
22.2 Force Majeure means including but not limited to government policies or related institutions, strikes, riots, battles, wars, fires, acts of terrorism, sabotage, explosions, embargoes, storms, floods, earthquakes, damage to third party software, behavior third parties (including but not limited to hackers), failures or problems with public facilities (including electrical, telecommunications or internet failures).
